Merchant Service Agreement
By installing Fittera from the Shopify App Store, you agree to comply with these Terms of Service. You represent that you have legal authority to enter into this agreement on behalf of your Shopify merchant store.
Subscriptions & Monthly Credit Allocations
Fittera subscriptions are billed through Shopify Recurring Application Charges. Each subscription tier grants a monthly allocation of generation credits:
- Credit Consumption: One credit is consumed when generating a new try-on image for a unique customer portrait and product variant.
- Instant Free Caching: Repeat requests with previously processed portrait and variant combinations consume 0 credits and deliver instant cached previews.
- Renewal Cycle: Monthly credit balances reset at the start of each billing cycle and do not roll over.
Acceptable Use & Content Responsibilities
Merchants are responsible for ensuring catalog product imagery complies with copyright laws. Merchants must not upload or process explicit, offensive, or non-consensual images. Fittera reserves the right to suspend accounts violating safety guidelines.
Generative AI Visual Fit Disclaimer
Fittera provides visual fit simulations designed to increase buyer confidence. Generated outputs do not guarantee physical garment stretch or exact tailoring measurements. Store size charts and product descriptions remain the primary source of fit specification.
Service Uptime & Infrastructure SLA
Fittera targets 99.9% uptime for storefront Mirror Room widgets. Rate limiting safeguards protect merchant stores against automated bot traffic or malicious credit exhaustion attempts.
Data Processing Agreement
This section forms a data processing agreement between the merchant and TechnoBrains Business Solutions LLP (519-521, Iscon Emporio, Jodhpur Village, Ahmedabad - 380015, Gujarat, India) and applies whenever the app processes personal data on the merchant’s behalf. It takes effect when the app is installed and continues for as long as that processing lasts.
Roles. The merchant is the data controller. TechnoBrains Business Solutions LLP is the processor. The merchant remains responsible for having a lawful basis to process their customers’ data and for the notices given to those customers.
Scope of processing. Subject matter: providing AI virtual try-on. Duration: the life of the installation, plus the retention described in our Data Retention policy. Categories of data subject: the merchant’s customers and storefront visitors. Types of personal data: customer identifiers, names and email addresses drawn from Shopify, customer-supplied selfie portraits, generated try-on imagery, and usage records. Portraits are photographs of identifiable people and are treated as sensitive.
Instructions. We process personal data only on the merchant’s documented instructions, which comprise these terms, the app’s configuration, and the merchant’s use of its features. We do not sell personal data, and we do not use it to train AI models or for our own marketing. If an instruction appears to breach data protection law, we will say so before acting on it.
Confidentiality. Access to merchant and customer data is limited to personnel who need it to operate or support the service, and those personnel are bound by confidentiality obligations that survive the end of their engagement.
Security. We apply measures appropriate to the risk: encryption in transit for all traffic, encrypted database backups, access to production restricted to named operators using key-based authentication, administrative accounts protected by password complexity requirements and lockout, and audit logging of administrative actions. Server-side authorisation checks constrain every storefront request to the requesting shop, customer, product and variant. Our security measures are described further in our Privacy Policy, and a current summary is available on request.
Sub-processors. The merchant gives general authorisation for the sub-processors listed in our Privacy Policy, currently Shopify Inc., Hivelocity, Inc. for hosting, our generative AI compute provider, and PLACEHOLDER_REPLACE_ME for transactional email. We impose data protection obligations on each of them no less protective than those in this section, and we remain liable for their performance. We will give notice before adding or replacing a sub-processor, and the merchant may object on reasonable data protection grounds; if the objection cannot be resolved, either party may terminate the affected service.
Assisting the merchant. We assist with requests from data subjects and with data protection impact assessments and consultations, taking into account the nature of the processing and the information available to us. Shopify’s mandatory customers/data_request, customers/redact and shop/redact webhooks are implemented, so access and erasure requests raised through Shopify are actioned automatically.
Personal data breaches. We notify the merchant without undue delay after becoming aware of a personal data breach affecting their data, with the information available at the time, and provide further detail as the investigation progresses. Our internal handling follows a documented incident response policy.
Audit. We make available the information necessary to demonstrate compliance with this section and will contribute to audits, including inspections, conducted by the merchant or an auditor they mandate, on reasonable notice and subject to confidentiality.
Deletion and return. On termination, personal data is deleted as described under Termination & Data Removal below. A merchant may request an export before uninstalling; after deletion, copies persist only in encrypted backups until those backups age out on their normal retention cycle.
International transfers. TechnoBrains Business Solutions LLP operates from India and the service is hosted by Hivelocity, Inc.. Personal data originating in the UK or EEA is therefore transferred outside those territories. Where such a transfer requires a safeguard under applicable law, the parties will enter into the relevant Standard Contractual Clauses, which are incorporated into this agreement by reference on request to [email protected].

Termination & Data Removal
Merchants may cancel their subscription at any time by uninstalling the application in Shopify Admin. Uninstallation triggers automated data redaction routines in compliance with Shopify partner policies.
